These Terms of Use (the "Terms of Use") apply to this World Wide Web site and any variations or successors to this website (video.mit.edu, "MIT Video Site") and any "MIT Video" branded software downloadable or otherwise available from the MIT Video website ("MIT Video Applications") (collectively, "MIT Video Network" or the "site"). MIT Video Network is managed by the Massachusetts Institute of Technology's video team (herein, "MIT Video").

Your use of MIT Video Network, and your access to and use of the content on MIT Video Network, are subject to these Terms of Use, as well as MIT Video's Privacy Policy. Any further reference to "Terms of Use" herein include MIT Video's Privacy Policy.

Users who visit MIT Video Network merely wishing to view content do not need to register and become members. However, any use of this site (which includes but is not limited to simply viewing the site's content) constitutes your acknowledgment and acceptance of these Terms of Use, which takes effect the moment you first use the site. Massachusetts Institute of Technology ("MIT") operates the MIT Video Network and reserves the right at any time to change the terms, conditions and notices under which the services of the MIT Video Network are offered, including but not limited to these Terms of Use, by posting such changes online. It is your responsibility to refer to and comply with these updated Terms of Use upon accessing the site. Your continued use of this site after changes are posted constitutes your acceptance of these Terms of Use as modified.

If these Terms of Use are not accepted in full, you do not have permission to access the contents of this site and you should cease using this site immediately.

If there is any conflict between these Terms of Use and any rules and/or specific terms of use appearing elsewhere on this site or on the site(s) of any third-party providers relating to specific material, then the latter shall prevail, but only as to the specific material to which they relate.

ABOUT MIT VIDEO

MIT Video is a video aggregation service that collects and displays references to videos created by the MIT Community, including MIT students, faculty and staff, as well as external copyright holders.

MIT Video does not provide a mechanism for members of the MIT Community or external Users to upload or add video files directly to this website. Rather, MIT Video references and embeds videos from external, third-party websites and services, such as YouTube and Vimeo, and other MIT websites, such as MIT's TechTV. Although Users can access these videos via the MIT Video site, they are not hosted on servers controlled or maintained by MIT Video.

For each video shown on MIT Video, when available, MIT Video posts source information concerning the video, including the identity of the video host (herein, "Source") and the corresponding licensing terms, if any, under which the video is offered.

Website Usage

You understand that when using the MIT Video Network, you will be exposed to content provided by third parties not under MIT's control ("User Submitted Media") from a variety of sources, and that MIT is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Submitted Media. You further understand and acknowledge that you may be exposed to User Submitted Media that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against MIT with respect thereto, and agree to indemnify and hold MIT, its Owners/Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the site.

Website Access

In order to access some features of the MIT Video Network, you will have to create an account. You may never use another user's account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify MIT Video immediately of any breach of security or unauthorized use of your account. Although MIT will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of MIT or others due to such unauthorized use.

You agree not to use or launch any automated system, including without limitation "robots," "spiders," "offline readers," etc., that accesses the MIT Video Network in a manner that sends more request messages to the MIT Video Network servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. Notwithstanding the foregoing, MIT grants the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. MIT reserves the right to revoke these exceptions either generally or in specific cases. You agree not to collect or harvest any personally identifiable information, including account names, from the MIT Video Network, nor to use the communication systems provided by the MIT Video Network for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the MIT Video Network with respect to their User Submitted Media.

Who May Use The MIT Video Network

AGE REQUIREMENT: You must be at least 13 years old to use the MIT Video Network. If you are at least 13, but are still a minor (this depends on where you live), you must have your parent or legal guardian's permission to use the MIT Video Network. Please have him or her read these Terms of Use with you.

NOTICE TO PARENTS AND GUARDIANS: By granting your child permission to use the MIT Video Network, you agree to these Terms of Use on behalf of your child. You are responsible for monitoring and supervising your child's use of the MIT Video Network. If your child is using the MIT Video Network and is either under 13 or does not have your permission, please contact us immediately so that we can disable his or her access.

WARNING: Even if you are old enough to use the MIT Video Network and/or have your parent's or guardian's permission, some of the content available within the MIT Video Network may not be appropriate for you. Some content may contain mature subject matter. If you are under 18, do not view such content.

Termination

Your use of the MIT Video Network is subject to your ongoing compliance with these Terms and Conditions. You acknowledge and agree that MIT may terminate and/or suspend your access to any portion of the MIT Video Network for any reason, including your failure to comply with these Terms and Conditions or any other guidelines and rules published by MIT. Any such termination or suspension shall be in MIT's sole discretion and may occur without prior notice, or any notice. MIT further reserves the right to terminate or suspend any user's access to MIT or to any portion of the MIT Video Network for any conduct that MIT, in its sole discretion, believes is or may be directly or indirectly harmful to other users, to MIT or its subsidiaries, affiliates, or business contractors, or to other third parties, or for any conduct that violates any local, state, federal, or foreign laws or regulations. MIT further reserves the right to terminate or suspend any user's access to the MIT Video Network for any reason or for no reason at all, in MIT's sole discretion, without prior notice.

Content Not Screened or Error Free

You acknowledge and agree that by using the MIT Video Network, you may be exposed to Content that is offensive, indecent or objectionable. You further acknowledge and agree that the Services and the Content may contain errors or omissions. You acknowledge and agree that MIT does not screen or review videos that are accessible via the MIT Video Network to determine whether it contains false or defamatory material, or material which is offensive, indecent, objectionable, or which contains errors or omissions. Under no circumstances will MIT be liable in any way for any user or other third party Content, including, but not limited to, for any defamation, falsehoods, errors or omissions in any such Content, or for any loss or damage of any kind incurred as a result of the use or publication of any such Content posted, emailed or otherwise transmitted via the MIT Video Network. MIT does not guarantee that any Content will be to your satisfaction.

User Agreement Not to Circumvent CONTENT PROVIDERS' Ownership Rights.

You acknowledge and agree that your rights to view the publisher content that you access via the MIT Video Network are strictly limited to the terms imposed by the owner of that content as set forth on the webpage that hosts the content..Except as permitted expressly by such rights, you may not copy, reproduce, modify, publish, transmit, transfer or sell, maintain, retain, create derivative works from, distribute or re-distribute, perform, link, display or in any way exploit any Content accessed via the MIT Video Network, including, without limitation, by incorporating data and or Content from the Service into any e-mail, search, catalogue, directory, or other "white pages" products or service, whether browser-based, based on proprietary client-site applications, web-based, or otherwise. You understand, agree and acknowledge that engaging in any of the aforementioned conduct may constitute a crime and/or other form of unlawful behavior for which you may be held criminally and/or civilly liable.

CODE OF CONDUCT

In using the MIT Video Network, you must behave in a civil and respectful manner at all times. Further, you will not:

  • Act in a deceptive manner by, among other things, impersonating any person;
  • Harass or stalk any other person;
  • Harm or exploit minors;
  • Distribute "spam";
  • Collect information about others; or
  • Advertise or solicit others to purchase any product or service within the MIT Video Network.

MIT has the right, but not the obligation, to monitor all conduct on and content submitted to the MIT Video Network.

MIT Video Network reserves the right to terminate your access to any or all of the services offered by MIT Video Network at any time without notice for any reason whatsoever.

COPYRIGHT AND OTHER INTELLECTUAL PROPERTY

MIT and MIT Video respect the intellectual property rights of the providers of content that can be accessed via MIT Video, and it expects that members of the MIT Community and external Users who upload videos will do the same. Upon receipt of written notice certifying that (i) you (or someone who has delegated to you authority to act on their behalf) are the owner of copyrighted material contained in a video that can be accessed via MIT Video and (ii) you believe, in good faith, that such material is being used without authorization, MIT Video will expeditiously disable access to that video through the MIT Video website. Please include in your notice reasonably sufficient information to enable MIT Video to locate the video in question. You must also include your contact information (e-mail address and phone number) in case MIT Video needs to communicate with you further.

Although MIT Video will disable access to allegedly infringing videos via the MIT Video website, because it merely acts as an aggregation service and such videos are hosted on servers neither controlled nor maintained by MIT Video, MIT Video cannot completely disable access to a video via the Source or another video aggregators. Please consult the copyright policies of the respective Source(s) to determine how to remove videos from their site(s). The non-video content on the MIT Video Network site, including without limitation, the logo, text, software, graphics and images, is owned by or licensed to MIT, subject to copyright and other intellectual property rights under United States Copyright Act and trademark laws, foreign laws, and international conventions. MIT reserves all rights not expressly granted in and to the website and said content. Other than as expressly permitted, you may not engage in the unauthorized use, copying, or distribution of any of said content.

In accessing the MIT Video Network site, you agree that you do so only for your own personal, educational, or non-commercial use. Unless otherwise stated, you may not distribute, transmit, broadcast, commercially exploit or modify in any way the site's material or content or permit or assist any third party to do the same. The MIT Video Network site includes a combination of content that we license from third-party partners and content that is created and posted by our users. All of the content on the MIT Video Network site is protected by our copyrights, the copyrights of our partners and/or the copyrights of the user who posted such materials. Materials submitted to MIT Video Network may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you download the materials.

Any rights not expressly granted herein are reserved.

CONTENT REMOVAL

Our goal is to promote the free-flowing exchange of expression relating to members' interests, activities and hobbies while maintaining high standards of respect and decency. In order to attain this goal, and in addition to the other content and/or action restrictions set forth in these Terms of Use and elsewhere on the MIT Video Network website, we will exclude the following content on MIT Video Network:

  • Content involving nudity, including but not limited to, nudity or partial nudity of children of any age.
  • Content that exploits children or minors or that discloses any personally identifying information beyond a first name about persons under the age of 18.
  • Content that disseminates personal information about another individual for malevolent purposes, including libel, slander, defamation or harassment.
  • Content that is or may be deemed to be grossly offensive to the online community, including but not limited to, blatant expressions of bigotry, prejudice, racism, hatred and profanity.
  • Content promoting or providing instructional information about illegal activities.
  • Content promoting or providing instructional information about dangerous activities.
  • Content depicting cruelty to animals.
  • Copyrighted content or material that is used without the express permission of the owner.
  • Content intended to abuse, harass, stalk, threaten or otherwise violate the legal rights of others (such as the rights of privacy and publicity).
  • Content that contains software or other material protected by intellectual property laws unless you own or control the rights thereto or have secured all necessary consents and/or licenses.
  • Content or other material that contains viruses, corrupted files, or any other similar software or programs that may damage the operation of MIT Video Network's server or another user's computer.
  • Content that violates any applicable laws or regulations not specifically referenced herein.

MIT Video Network does not endorse or entirely control the content, messages or information found in any user-generated content and, therefore, MIT Video Network specifically disclaims any liability with regard to such user-generated content and any actions resulting from such user-generated content.

MIT Video Network reserves the right to remove any materials in its sole discretion for any reason or no reason, at any time, with or without notice to you. A video's removal is at the discretion of MIT Video; because our content is embedded from third-party sites, a removal from the MIT Video Network does not mean it has been removed from the original source.

You agree to use the services provided by MIT Video Network only for their intended, lawful purposes and in accordance with all applicable laws. You agree not to use MIT Video Network in any manner that interferes with its normal operation or with any other users use and enjoyment thereof. You further agree that you will not access MIT Video Network by any means except through interfaces provided by MIT Video Network and that you will not access MIT Video Network from any territory where its contents are illegal.

THIRD PARTY SITES / LINKS TO THE MIT VIDEO NETWORK

MIT Video Network may contain links to other websites not affiliated with MIT (Linked Sites). The Linked Sites are not under the control of MIT, and MIT is not responsible for the contents of any Linked Site, including without limitation, any link contained in a Linked Site, or any changes or updates to a Linked Site. MIT is not responsible for webcasting or any other form of transmission received from any Linked Site. MIT Video Network is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by MIT or any association with its operators.

MISCELLANEOUS
